Subject: Freedom of Information Act Procedures

Enclosed is a copy of the final Freedom of Information Act (FOIA) Procedures adopted by the National Indian Gaming Commission (NIGC, or the Commission) pursuant to 5 U.S.C. 552a. The regulations were published in final form in the Federal Register on Monday, August 23, 1993 at pages 44445-44451.

Congress enacted FOIA in an effort to afford greater public access to government records. Under FOIA, federal agencies must publish, in the Federal Register, procedures by which the public may obtain access to information.

The NIGC's regulations provide procedures under which the public may request access to certain information compiled, created and maintained by the Commission. Additionally, the regulations include provisions for withholding information that is exempt from disclosure under one or more of the FOIA's nine exemptions.
