The National Environmental Policy Act (NEPA) Decision of Records
The National Environmental Policy Act (NEPA) requires federal agencies to assess the environmental effects of their proposed actions prior to making decisions. Using the NEPA process, agencies evaluate the environmental and related social and economic effects of their proposed actions. Specifically, all federal agencies are to prepare detailed statements assessing the environmental impact of and alternatives to major federal actions significantly affecting the environment.
These statements are commonly referred to as Environmental Assessments (EA) and Environmental Impact Statements (EIS). Both the ES and the EIS process have an opportunity for public participation or comment. An EA can result in a finding of no significant impact (FONSI) or a recommendation to prepare an EIS. The EIS process ends with a Record of Decision (ROD) documenting the decision on the action. The Council on Environmental Quality regulations (40 C.F.R. §§ 1501.4(e)(1), 1505.2, and 1506.6) require these documents be publically available.
